Terms and Conditions

1. Legal Identity & Scope of Agreement

This Terms and Conditions Agreement ("Agreement") is a legally binding contract between:

• GCC ERA PRIVATE LIMITED, a company incorporated under the Companies Act, 2013 (hereinafter "GCC ERA", "GCCERA", "Company", "we", "us", or "our"), and
• Any individual, entity, organization, or representative thereof accessing or using the Platform (hereinafter "User", "you", or "your").

This Agreement governs access to and use of:

• www.gccera.com and all subdomains (including gccera.com/products)
• The GCC ERA mobile applications for Android (package com.gccera.app) and iOS, and any future mobile applications
• SaaS tools, dashboards, AI engines
• Community features
• Events (virtual and physical)
• Content, reports, databases, APIs
• Paid and unpaid offerings

If you do not agree, you must immediately discontinue use.

2. Legal Capacity & Age Requirements

• The Platform is intended for working professionals aged 18 years or above. Under the Indian Contract Act, 1872, a person below 18 cannot enter into a binding contract, and under the DPDP Act, 2023 §9 a person below 18 is a child.
• We do not knowingly permit any person below 18 to create an account or transact on the Platform. Where a person below 18 is permitted to access limited features, this requires verifiable consent from a parent or lawful guardian, who then accepts this Agreement on their behalf and is responsible for their use of the Platform.
• By using the Platform you represent that: (a) you are 18 or above, or are acting with verifiable parental or guardian consent; (b) you are legally competent to enter into a binding contract; and (c) all information submitted by you is lawful, accurate, and authorised for disclosure.
• If we learn that a person below 18 has created an account without such consent, we will suspend the account and delete the associated data.

3. Platform Description & No Agency Relationship

GCC ERA is a technology-driven intelligence, aggregation, and community platform focused on the GCC (Global Capability Centre) ecosystem.

GCC ERA IS NOT:

• An employer
• A recruitment agency
• A staffing firm
• A hiring authority
• A guarantor of employment outcomes

No relationship of employer–employee, principal–agent, partnership, or joint venture is created between GCC ERA and any User or Company.

4. GCC Classification, Database & Market Intelligence Disclaimer

GCC ERA maintains proprietary databases identifying:

• Whether a company qualifies as a Global Capability Centre
• Sector, industry, maturity, and operational status

These classifications are based on internal methodologies, public data, and market signals; updated approximately every six months. GCC ERA does not warrant absolute accuracy. Discrepancies may be reported to [email protected]. GCC ERA shall not be liable for decisions made based on such classifications.

5. User Accounts & Information Accuracy

Certain features require account creation. Users agree to provide accurate, complete, current, and non-misleading information. GCC ERA reserves the right to suspend or terminate accounts with false or misleading data.

6. High-Risk Professional & Sensitive Data Submission

Users may voluntarily submit highly sensitive professional data, including but not limited to:

• CVs / resumes
• Salary slips and compensation details
• CTC breakdowns
• Employment hierarchy data
• Employer details
• Career history
• Voice recordings from mock interview sessions and their transcripts

By submitting such data you expressly confirm:

• You have full legal right to share it
• Submission does not breach any employment contract or NDA
• GCC ERA is indemnified against third-party claims arising from such submission

GCC ERA does not verify the authenticity or accuracy of any professional or compensation-related information submitted by users.

Voice recording note: Each voice mock session displays a separate consent prompt before recording begins; by clicking "Start interview" you provide explicit consent for audio recording, transcription, and AI scoring as detailed in our Privacy Policy §12.

7. AI, Matching, Scoring & Algorithmic Disclosures and Disclaimers

7.1 Use of Artificial Intelligence and Automated Systems

GCC ERA uses artificial intelligence (AI), machine learning models, statistical techniques, and rule-based algorithms to support certain features, including:

• Analysis of user profiles, resumes, and professional information
• Identification and suggestion of job opportunities and career options
• Skill, role, sector, and company alignment
• Generation of market intelligence, insights, rankings, and recommendations

7.2 Nature, Scope, and Limitations of AI Outputs

All outputs, insights, suggestions, scores, rankings, or recommendations generated through AI or algorithmic systems:

• Are informational, indicative, and probabilistic in nature
• Are derived from available data, user-provided information, historical patterns, and system logic
• Do not constitute guarantees, assurances, representations, or promises of accuracy, completeness, suitability, or outcomes
• May change, evolve, or be discontinued as systems are updated

7.3 No Automated Decisions with Legal, Employment, or Financial Effect

GCC ERA does not use AI to make decisions with legal, contractual, employment, financial, or similarly significant effect. All hiring, interview, selection, rejection, compensation, and employment-term decisions are made solely and independently by third-party employers or organizations — not by GCC ERA.

Where scores, assessments, or match results about you are made visible to an employer or recruiter through the Platform, this occurs only on the double-consent basis set out in Privacy Policy §5A, and the employer remains solely responsible for any decision it takes. If you believe an automated output about you is materially inaccurate or unfair, you may request human review under Privacy Policy §5B by emailing [email protected] with subject "Review my result".

7.4 Human Oversight and System Controls

AI-generated outputs may, at GCC ERA's sole discretion, be reviewed, monitored, adjusted, restricted, or overridden by human administrators; supplemented with non-automated inputs; or removed, corrected, or limited without notice. The presence of human oversight does not imply an obligation to review every AI-generated output.

7.5 Data Dependency and System Constraints

AI and algorithmic systems depend on the accuracy, completeness, and relevance of data provided by users and third-party sources; may reflect data gaps, outdated information, or systemic limitations; and may produce different results for similar inputs due to evolving models or contextual factors.

7.6 Disclaimer of Liability Relating to AI and Algorithms

To the maximum extent permitted by law, GCC ERA expressly disclaims all liability arising from:

• Errors, inaccuracies, or omissions in AI-generated outputs
• Algorithmic bias, model limitations, or data quality issues
• Missed opportunities, perceived mismatches, or unfavourable outcomes
• Non-selection, rejection, lack of interview calls, or hiring decisions
• Any reliance placed by users or third parties on AI-assisted outputs

7.7 User Responsibility and Independent Judgment

Users acknowledge that AI-assisted features are decision-support tools only. Users remain solely responsible for their professional, career, and employment decisions, and must apply independent judgment, verification, and discretion.

7.8 No Warranties or Representations

GCC ERA makes no warranties or representations, express or implied, regarding accuracy, reliability, suitability, or fitness of AI outputs for any particular purpose. AI-assisted features are provided on an "as-is" and "as-available" basis.

7.9 Data Export and AI Training Opt-out

Users may request a full export of their personal data and AI-generated content at any time per Privacy Policy §8 (dashboard → "Download my data"). Exports are delivered as a JSON file; we aim to fulfil within 36 hours and will in all cases respond within 30 days. Each download is a one-time use. Users may opt out of having their data used to improve our AI models by emailing [email protected].

8. Job Aggregation & External Applications

• GCC ERA only aggregates job opportunities. Users are redirected to company websites or third-party portals.
• GCC ERA does not control hiring decisions, influence selection, or guarantee interviews.
• All hiring outcomes are solely between the User and the hiring entity.

9. Payments, Subscriptions, Refunds & Cancellations

9.1 Paid Services

GCC ERA may offer paid products and services, including subscriptions, premium platform access, reports, insights, events, tools, and other digital offerings ("Paid Services"). All fees are payable in advance unless expressly stated otherwise.

9.2 Payment Processing

Payments are processed through Razorpay or other authorised third-party payment gateways. GCC ERA does not store full payment card, banking, or wallet credentials.

9.3 Nature of Digital Services

GCC ERA provides digital, SaaS-based, intelligence, content, and community services, many of which are delivered immediately upon payment or accessible instantly after activation. Accordingly, such services are not comparable to physical goods and are subject to different refund principles.

9.4 No Automatic Refunds

Unless explicitly stated otherwise in writing by GCC ERA:

• All payments made on the Platform are non-refundable
• Subscriptions cannot be cancelled mid-billing cycle
• Partial usage, non-usage, dissatisfaction, or change of intent do not entitle the user to a refund
• Failure to obtain expected results, opportunities, interviews, or outcomes does not constitute deficiency of service

This section is subject to applicable consumer-protection law (Section 9.11).

9.5 Refund-Eligible Scenarios

Refunds may be considered solely at GCC ERA's discretion in the following limited circumstances:

• Duplicate payment for the same service in the same session
• Technical failure attributable to GCC ERA that prevents service activation within 24 hours of payment
• Payment debited but service not provisioned
• Service unavailable for >72 consecutive hours due to GCC ERA infrastructure issues during the active subscription period
• Account erroneously charged after deletion has been confirmed

No other circumstances create a refund obligation.

9.6 Subscription Cancellation

For annual subscriptions (Edge Plan ₹1,999/year, AI CV Generator ₹2,399/year, AI Job Match ₹1,499/year):

• Cancel auto-renewal at any time via Dashboard → Helpful Links → More
• Cancellation takes effect at the end of the current billing period; you retain full access until then
• No prorated refund is issued for the unused portion
• One-time purchases (CIR ₹599, Premium Mock ₹1,099) are not subscriptions and expire by their stated terms

9.7 Account Deletion and Active Subscriptions

Users with an active paid plan who delete their account during the subscription period waive any right to refund of the unused portion. The 30-day grace period (Privacy Policy §7) lets users reconsider before any data is lost.

9.8 Events

• Event registrations (virtual or physical) are non-refundable
• GCC ERA may reschedule, modify, substitute speakers, or change event formats without liability
• If an event is cancelled entirely by GCC ERA, refunds (if any) are processed at our discretion

9.9 Refund Requests & Timelines

All refund requests must be submitted in writing to [email protected] with subject "Refund request" and including:

• Your registered email (the one used for purchase)
• The Razorpay payment ID (visible in your payment receipt)
• The product/service purchased
• A clear description of the refund-eligible scenario (Section 9.5)
• Date of purchase

We acknowledge requests within 2 business days and respond with a decision within 7 business days. If approved, refunds are processed within 7 to 14 business days via the original payment method.

9.10 Chargebacks

If you dispute a charge with your bank/card issuer without first contacting us, your GCC ERA account may be suspended pending dispute resolution. If the chargeback is found invalid by the card network, we reserve the right to terminate your account.

9.11 Statutory Rights

Nothing in this section limits any non-waivable statutory rights available to users under applicable Indian consumer-protection laws, including the Consumer Protection Act, 2019. Where any provision of Section 9 conflicts with such a right, the statutory right prevails and the rest of Section 9 continues to apply. Disputes may be escalated to the Consumer Disputes Redressal Commission or Razorpay's Customer Grievance at razorpay.com/customer-grievance.

9.12 Purchases Made Through Mobile App Stores

Purchases made on the Platform — including from within the mobile app — are processed by Razorpay and governed by this Agreement. Where a purchase is instead made through Apple's App Store or Google Play billing, that store's own refund policy and process apply to it, and refund requests for those transactions must be made to the store rather than to us. Nothing in this Agreement overrides the terms of the app store through which you obtained the app.

10. Intellectual Property & Proprietary Rights

10.1

All platform elements including content, databases, AI models, methodologies, logos, and reports are the exclusive intellectual property of GCC ERA PRIVATE LIMITED.

10.2

Unauthorised scraping, reverse engineering, reproduction, or commercial use of platform elements is strictly prohibited.

11. User-Generated Content License

You retain full ownership of everything you submit. The licence below exists only so that we can operate the Platform for you, and it is deliberately limited.

11.1 Personal and professional data

Your CV, salary and compensation details, career history, voice recordings, transcripts, and any documents you upload are not covered by a public or perpetual licence. We process them only as described in the Privacy Policy — to deliver the features you use — and we do not publish, sell, license, or distribute them. This permission ends when you delete the content or your account, subject only to data we are legally required to retain and to backups purged on the schedule in Privacy Policy §6.

11.2 Content you publish publicly

Where you deliberately post content into a public or shared area of the Platform — community posts, comments, reviews, blog submissions, or event contributions — you grant GCC ERA a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content for the purpose of operating and promoting the Platform. This licence is revocable: it ends when you delete the content, except that (a) we may retain backup copies until they are purged on the normal schedule, and (b) copies already shared onward by other users or indexed by third parties may persist outside our control.

11.3 Feedback

Suggestions, feature requests, and bug reports you send us may be used without restriction or obligation to you.

11.4 AI training

We do not use your CV, transcripts, or interview content to train AI models unless you have given explicit opt-in consent, which you may withdraw at any time by emailing [email protected].

12. Prohibited Conduct

Users shall not:

• Misuse data
• Attempt system breaches
• Impersonate entities
• Violate laws
• Upload malware
• Harvest data
• Misuse the voice mock features (recording or distributing another person's voice without consent)

13. Events & Community Interactions

13.1

Participation is voluntary.

13.2

GCC ERA is not liable for statements by speakers, outcomes of networking, or third-party interactions.

Community Guidelines (binding part of this Agreement)

Expected conduct: Be respectful and professional · Share accurate and lawful content · Engage constructively.

Prohibited content: Harassment, hate speech, abuse · False or misleading claims · Spam or promotions without permission · Confidential employer information · Illegal content.

Content moderation: GCC ERA reserves the right to remove content, suspend or ban users, or restrict visibility. Violations may result in suspension or termination under Section 17.

Reporting: Violations can be reported to [email protected].

14. No Professional Advice

Nothing on the Platform constitutes legal advice, tax advice, employment guarantees, or investment advice.

15. Limitation of Liability

To the maximum extent permitted by law:

• (a) GCC ERA shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• (b) GCC ERA's aggregate liability, if any, shall not exceed the total fees paid by the user to GCC ERA in the twelve (12) months preceding the event giving rise to the claim.
• (c) Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability under non-waivable consumer-protection or data-protection law.

16. Indemnity

Users agree to indemnify GCC ERA against breach of this Agreement, data misuse, third-party claims, and regulatory penalties arising from user conduct — including reasonable legal fees and costs.

17. Termination

17.1 Termination by GCC ERA

GCC ERA may suspend or terminate access without notice for violations, security reasons, or legal reasons.

17.2 Termination by User

Users may terminate their account at any time via Dashboard → Helpful Links → More → "Delete my account". Termination triggers a 30-day grace period — see Privacy Policy §7 for the deletion mechanism. After 30 days, all user-owned data is permanently and automatically deleted (with the exception of items legally required to retain, including payment metadata held for 8 years per Income Tax Act). Once deletion is irreversible, the user may register again but starts as a new user with no historical data.

18. Governing Law & Dispute Resolution

• This Agreement is governed by the laws of India.
• Talk to us first. Before commencing formal proceedings, please raise the matter with our Grievance Officer (Section 19). Most issues are resolved at this stage. We acknowledge within 24 hours and resolve within 15 days.
• Arbitration. Disputes not resolved that way shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue shall be Guwahati, Assam, and the language shall be English.
• Consumer carve-out. Nothing in this section requires a consumer to arbitrate where non-waivable law gives them the right to approach a Consumer Disputes Redressal Commission or other statutory forum, and nothing here removes your right to complain to the Data Protection Board of India.
• Small claims and urgent relief. Either party may seek interim or injunctive relief from a court of competent jurisdiction without first arbitrating.
• The courts at Guwahati, Assam shall have exclusive jurisdiction for any matter not subject to arbitration, subject to the consumer carve-out above.

19. Grievance Officer

In accordance with Information Technology Rules, 2021 §3(2)(b) and DPDP Act §13:

• Resolution: Within 15 days, as required by Rule 3(2)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. In practice we aim to respond substantively within 7 calendar days.

Where a complaint concerns content on the Platform, we will act on a valid order from a court or an authorised government agency within 36 hours of receiving it, as Rule 3(1)(d) of those Rules requires.

Unresolved concerns may be escalated to the Data Protection Board of India.

19A. Mobile Applications — Licence and App Store Terms

19A.1 Licence to use the app

Subject to this Agreement, GCC ERA grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the GCC ERA mobile app on a device you own or control, for your own non-commercial use. You may not copy, modify, reverse engineer, decompile, redistribute, or create derivative works from the app, except to the extent such restriction is prohibited by applicable law.

19A.2 App store terms also apply

Your use of the app is additionally subject to the terms of the store from which you obtained it (Apple App Store or Google Play). Where those terms conflict with this Agreement in respect of the app itself, the store's terms prevail to the extent of the conflict.

19A.3 Apple-specific terms

Where you obtained the app from the Apple App Store, you acknowledge that: this Agreement is between you and GCC ERA only, not Apple; Apple has no obligation to provide maintenance or support for the app; in the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims; and Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

19A.4 Google Play

Where you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to this Agreement and is not responsible for the app.

19A.5 Updates and availability

We may release updates, and some updates may be required for the app to keep working. We may discontinue support for older app or operating-system versions. The app requires an internet connection for most features; data charges from your carrier are your responsibility.

19A.6 Device permissions

Microphone, notification, biometric, and storage permissions are requested only for the features that need them, are optional, and may be revoked at any time in your device settings. See Privacy Policy §12A.

20. Force Majeure

GCC ERA shall not be liable for any failure or delay in performing obligations caused by events beyond reasonable control, including but not limited to natural disasters, pandemics, internet outages, infrastructure failures by third-party processors (Supabase, Razorpay, etc.), governmental actions, or war.

21. Severability

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and GCC ERA regarding use of the Platform. It supersedes any prior agreements or understandings, written or oral.

23. Updates

We may update this Agreement. The "Last updated" date at the top reflects the latest revision. Material changes will be emailed to all account holders 30 days before they take effect, and mobile app users will additionally see notice of the update in the app. Existing subscriptions remain governed by the Agreement in effect at the time of purchase until renewal.

For non-material changes, continued use of the Platform after the revision date constitutes acceptance. Where a change materially reduces your rights or increases your obligations, we will seek your affirmative acceptance rather than rely on continued use, and if you do not accept you may terminate under Section 17.2 without penalty.

Response times we promise

Anything escalated to the Data Protection Board of India is acknowledged within 30 days as required by DPDP §13.
